Sad as it is that he's sick, if the noise and smell are affecting you, you can -- and should -- speak to him about it. The noise issue might depend on how late it's going on, but it's still an issue. The smell -- well, frankly, no matter how sick he is or what he's sick with, the feds don't recognize the right to marijuana. While you might not have a problem with it, he should still know that the smell is getting out. Other people might be less inclined to sniff the other way. You'd be doing him a favor by letting him know, so he can avoid someone else calling the authorities.
High density living can be problematic. I'm on the board of directors for our homeowners' association, and we have to mediate some disputes between condo owners. It can be worse than dealing with six year olds. Not to mention the pin-pricks of annoyance that don't make it to the board. Things like our next door neighbors, having parties until 3AM, blasting their stereo. Things like that, which we try to deal with between ourselves, rather than taking it to the board.
