Tianeptine is also in the process of FDA trials for irritable bowel syndrome. If the trials are succesful it will be licensed in the US for this indication in the next few years, and psychiatrists can then prescribe it off-label for depression.
Although it's not an FDA approved drug, tianeptine isn't a controlled drug and you won't face any penalty if your shipment is seized. It's very unlikely to be seized because tianeptine is not a controlled substance and it is legal to import a small quantity for personal use in most countries. If your doctor is amenable, you can ask him to write a private prescription for tianeptine so you have peace of mind.
There are three different brand names but they're all made by Servier (a French pharmaceutical company). It's approved in France and a few other European countries. I think its is available as generic in India due to their relaxed patent laws, but I've never seen it. I'm taking the Coaxil brand now and just got a shipment of Stablon.
For the record I've ordered loads of meds (some of them controlled substances) and never had a problem. They always delivered and if a shipment was seized they always offered three reshipments before refunding my credit card.
