If you are in the US, you need to apply for a patent at the US Patent and Trademark Office in DC. Generally, you need the help of a patent attorney because it requires a specifically-detailed description/picture to enable the office to research similar items and ensure it is in fact unique. Takes forever, which is why so many things say "patent pending."

I say go for it and good luck! I don't think the actual filing fees are very high, it's the attorney who will charge a bunch. They have to have a bachelor's in a science or engineering field and pass a special bar examination to practice patent law, so an ordinary attorney can't do it for you.
