I'm not in Florida but when I heard this story awhile ago I took another look at the form they asked you to sign. When you poured through all the irrelevant information it did indeed say that you were giving them permission to use your information for marketing. In protest I took most of my business elsewhere. When I did need to use Eckerd I would refuse to sign and the clerk would sigh as though I was only trying to ruin her day. You signed a little sticker with your name on it that was stuck, along with all the other customers stickers, on a form that contained the release. I must not have been the only one refusing to sign because my local store decided to solve this problem by asking the customers to sign the sticker before they attached it to the consent form. But, when I picked up a prescription last week the form had changed. I read the entire form while the hovering clerk kept pointing to the form and saying "just sign here". Not only did it no longer contain the marketing consent clause but it also had a paragraph explicitly stating that the stickers must be attached to the form before they asked you to sign them. I had a feeling there was a legal settlement involved somewhere. I can't wait to see what they try instead.
