Without the entire email posted, I think regardless of who it is, it's impossible to say. Context goes a long way in this type of thing. I think the smilie face at the end was an attempt to add an "I am only kidding" to the end of the post. But warnings are a part of life here, and I've received mine before as well. If you disregard the warning, you will most likely be blocked for a week, no matter who is at fault.
