Q: News wire services, newspapers

I looked at the articles posted by Justice--the ones thought to be unfair use, and noticed many were from newswires like Reuters, or AP. Some were from newspapers, some from clearinghouses like Medscape. In many, the story is about the author and article, not the article itself (like a newspaper story about the findings of the author).

I wonder if the origination of the notice or report has any effect on fair use. These postings seemed to meet most of the fair use criteria, and vast majority of articles come from "public" sources designed to "spread the word" about the topic. All had proper reference back to the original author.

Anybody know if standards are different for different sources for the articles?

BTW, regarding the list, there were 11 posters who posted these articles. Two posters posted two articles each, 8 posted only one article, and the remaining articles were brought to us by one poster.
