Biophosphanates have been associated with that side effect... I can't say about litigation, tort suits have been around since time immortal...
Basically its a risk vs. benefit of those medications (Fosamax, Boniva, etc) and should be thoroughly discussed with your gynecologist / primary care provider before you make a decision to use one.
Common sense OTC agents for osteoporosis are supplements -- an increased amount of calcium (2000 mg / day) and phosphorus as well.
Due caution for calcium is noted though -- one shouldn't take more than about 500mg at a time if they are at risk for kidney stones. (Which basically means splitting the number of times you take calcium throughout the day).
The rest, you probably get from food.
