As noted by the esteemed Meri-Tuuli, it simply was not worth the expense to get FDA approval. The patent was indeed about to expire. By not getting it approved, however, they also blocked other companies from marketing it, unless those other companies were willing to bear the expense of clinical trials. Ain't gonna happen.
