Last year (Dec. 2001) I had a minor car accident. A passenger in the other car complained about her knee being jammed into the dash on impact. Now, just before the statute of limitations ran out, her lawyer filed suit against me in order to extend the statute. I admit about as much as 40% to 50% of the responsibility, but the paper the lawyer drew up about me (summons??) was terrible to read! It sounded like I am a menace on the road, that I was careless and reckless, which isn't the case at all! Argh! I am trying not to take it personally, though, but it pisses me off that there is a legal document that demeans my character! I have insurance, so this will probably never go to court, I am just frustrated, and wanted to see if anyone else has been through this. Do ya'll know what I should expect from here on out? Same thing hapened to me once. Go to your insurance company ASAP and give them the letter from the lawyer and have them examine your car. The problem is that this is probably too late for any action on their part. In any case, your insurance company is there exactly for these situations.
(In my case, I went to the insurance company right after the accident, they took photos, and we did nothing until we heard from the other party, who was of course uninsured. They sued for a couple million dollars for gross bodily injury. My insurance company settled for $499.00 on each of two claims. I have had no change in rates or other effects, and this was 14 years ago.)

The accident was over a year ago, and I did call my ins. co. immediately. We only carry liability, so we had my car fixed out of our pocket. We did take a couple of photos beforehand, though. Our ins. rates did not change after the accident, thank goodness!
I have mailed the letter (summons) to my ins. co., and they should receive it tomorrow. Fortunately, the suit was only for $25,000, and I am covered for twice that. I expect that there will be a very small settlement.
I just hate the way our American society has become so litigious (sp??). If a restaurant serves you hot coffee, you sue. What ever happened to personal responsibility and common sense!? (That may sound hypocritical given that I only claim 40-50% responsibility for the accident, but I do really try to claim my screw-ups and admit when I am wrong- but I am not *always* wrong!)
Maybe this thread should change to a more lighthearted version- What is the most outrageous lawsuit you have ever heard of?

Sorry to hear that. Hopefully, the insurance co. will take care of it. I don't know anything about these things, so I can't advise you on how it will go. Good luck.
