Has anyone filed a complaint ?

Posted by Diane J. on May 2, 2001, at 21:58:07

I filed a complaint against my therapist one year ago, and today I received a letter from the local branch of the Medical Board. I am supposed to contact the investigator for the case and schedule an interview. I'm not exactly looking forward to this...I feel very anxious!! Has anyone out there gone through this? Does anyone know anything about it? I would really appreciate hearing from anyone who has information. Thanks.

I've never done this though I had been told I could concerning the psychiatrist I saw. (Though I was too tired to bother.) Three hoorays for your bravo! Keep to the facts and try not letting your emotions get wind. Have a strong friend with you if it'll help.

Interesting you should mention this because I filed a complaint against my medical doctor at UCONN for discharging me from his practice because of a number of stupid reasons, one of which involved being "late several times" for appointments. Really earth-shattering, isn't it.

I first contacted UCONN Medical in Farmington, Connecticut, but, of course, it was easier for them to get rid of me than to discipline this incompetent, vulgar MD.

But then I did something else: I contacted Connecticut's Board of Public Health, and Department of Consumer Protection, the Governor's Office, etc., etc., etc. In other words, I dropped this into the laps of those in state government that are suppose to be there when you need them. If they can't help, they will put you in touch with those who can.

Then I did something else: I went federal and notified all these federal agencies.

Then, in conclusion, I decided to put up a quick web page as a public service to inform the potential 1.9 billion people out in cyberville about this quack. I included names and addresses and even digital pictures. Remember, my dear, via the Internet, you can reach more people in one hour than Oprah Winfrey can in one week. Stay tuned for the URL.

Something else to remember: word-of-mouth advertising, good or bad, is the best kind ... and payback is a bitch with a keyboard and a modicum of imagination.

Good luck, and don't be anxious; however, unless you have a lawyer and/or this is a serious case of malpractice, you'll be spinning your wheels for a long time. This is the way it is.

I'm in the process of doing this myself. I'm curious about something though. Can they sue you for saying that stuff since there is no 'proof' or whatever? I'm filing complaints with the Board of Healing Arts, Attorney General, AMA, APA, my insurance provider (I didn't even know you could do that), the Insurance Commissioner (sp?), Medicare, and if I think of anymore; those as well.

It does take a toll on you, however what this man did was worse, and I think worth it in the long run if he isn't allowed to continue with other patients. I've lost 30 pounds so far since March 1, 2001, and started cutting again. Something I haven't done since '96.

However, I can't seem to get an attorney to talk to me in this area. The last one I spoke with actually told me it would be a conflict of interest for the fact that they represent doctors at times, and it may upset them. Or.... they want this huge retainer, something a person on SSDI (disability) can't really afford with a family.

I do hope you can continue with it, and hope that you have a counselor, or therapist, or at least a support system that you can rely on.

Good luck, and I hope you'll keep us posted.

They won't because they know how this sort of litigation would appear in court. Frankly, I would welcome a lawsuit (in my case), giving me the opportunity to stand before a Judge to tell them personally, with ALL THE NECESSARY DRAMATICS, just how badly I was treated and just HOW DAMAGED I am today. So, let the bastards sue you, if they dare, but they know better so they won't even go "there," so to speak. Remember, you are the "David" fighting the "Goliath" and the judicial system don't like those scenarios.

Typical lawyer jargon meaning: if the case isn't a "deep-pocket" one, then they ain't interested; however, I did get a big laugh re. the "conflict of interest" bullcrap. It's a conflict of interest if, and only IF, that particular lawyer had that particular doctor as a client. "Conflict of Interest" clauses are not global, blanket statements. They have to be specific. It's like the lawyer saying, "Well, I can't sue Aetna Insurance Company because I have car insurance with GEICO." The fact that the lawyer may have had "some" doctor in the past as a client (probably to collect a debt) doesn't automatically recuse him from suing OTHER doctors, sheesh. Consider it a blessing you didn't retain this jackass. And something else: in a personal injury lawsuit, it's usually done on a contingency basis meaning "no up front fees" and they get 33 percent of the proceeds. The lawyer idea was a bad one from me: I apologize. I have little use for those money whores, also.

I am basically self-sufficent. My support system consists of my spirit and dreams to make things right for myself. I'll tell you something else: if you feel wronged by the system, then don't give up. Fight! Fight with all your might, even if it means a sacrifice, and hardship. People *do* and *will* listen, and there are a lot of good people out there, like us, who have been burned by a sloppy, incompetent, ineffective system that would stay that way if it weren't for the stamina of those who want to change it.

And my best to you, Kiddo

I have to tell you, I admire your attitude about it all. I had been really down ever since all of this started. REALLY down, but your post has brought out the "kiss a** and take names later" response I usually have.

I did hear from Medicare today. (They did turn my account over to collections-but I have a 300.00 credit, they are soooo incompetent.) Anyway, they did credit my account 160.00 so far. They overcharged me for what MC had already paid, and MC didn't like that too much. LOL!

At this point I'm not even sure I want an attorney. To hell with all of 'em as far as that goes. Maybe I'll do what all those people on Lifetime do and represent myself. It may be worth it to get to do the cross-examination.

I'm really glad that you have the outlook on things that you do, it shows just how much strength you really have.

Keep me posted on how it goes please?

My Pdoc did tell me that they don't take complaints very lightly, if that tells you anything.

Thanks again for the boost to my spirits.
