OMG!!!
i am SOOOOOO angry!my boss just pulled me in and told me about an ex-client of ours.
he is an elderly man that suffered a stroke some years ago. he was in a nursing home in a small town and was sexually molested by a worker there.
(we found that out last year)
BUT... it finally was going to court and some mother f-ing, a$$ wipe attorney, aggressively interviewed him and declared him 'incompetent'. the attorney was aggressively asking him dates and this client got confused...so they said he was incompetent!
so the charges against the PERVERT FREAK MOLESTER were dropped. now, luckily the guy was fired from the home...but with no charges on him he'll just find another old home and do it again!!! I'll bet MONEY oN IT!!
HOW DARE THEY declare him incompetent! yes he had a stroke and is mostly immobile, YES he gets Confused! but WHO DOESN"T!!
his communication is minimal, but it's not because he doesn't know what's going on, it's because he had a freaking stroke and his muscles just don't work! he STILL KNOWS WHATS GOING ON!
now i feel like he's a sitting duck! they could even 'neglect' him and he couldn't do anything about it...why? because he's INCOMPETENT!!!my boss volunteered ADAMANTLY to help the family,but he can't do ANYTHING without support of the spouse. and the spouse is just not sure what to do, since they live in a rural town and that's the only home he can go to without them moving...so i guess unless we hear otherwise...it's over.
just like freaking that!well hell, i couldn't tell you the dates that i was molested or raped, but that doesn't mean it didn't happen!!!!!!

I'm right there with you, B2. This is OUTRAGEOUS. Did the court appoint a guardian ad litem (or whatever the adult equivalent is)? Someone needs to be able to advocate for this man.
This kind of stuff makes me NUTS.

Yes; unfortunately in my work I see this quite frequently. Ironically, next week I will be seeing an older man who sexually asaulted an older woman in a nursing home. He IS being prosecuted. I have seen many SO's who are able to go to trial and with a good lawyer get off. On the other hand I just had a young guy I saw who is being charged with penile penetration of the victim. Problem is the victim, according to the doctor, has an intact hymen. So why the H are they going after this guy, and why isn't HIS attorney doing something. GEES!! And why is the State going after him????? Makes no sense.

thank you all for letting me vent about this.
it's just so frustrating to me to see this happen and not be able to DO anything.
i feel helpless....again.
i mean, this was a 70+ year old man, who i'm surprised said ANYTHING to begin with! i mean i guess i should be thankful that he was even fired...
but although the creep was fired...there is nothing that will stop him from doing it again. NOTHING.TG i don't know if the court appointed anyone, i believe his spouse is 'advocating' for him...
my boss feels that the state just didnt' want to 'deal' with it...i think they figured since the guy got fired then 'that was that' and didn't want to bother any further.

Unbelievable. In this day and age when we know much about recidivism rates amont sex offenders, it is unbelievable to me that the state somehow convinced themselves that this was okay because the perp. got fired.
Unbelievable.
